ASM Nasiruddin Elan, the Director of Odhikar and Adilur Rahman Khan, the Secretary were accused of committing offences under the Information and Communication Technology Act 2006 (amended in 2009) on 04 September 2013. While Adilur Rahman Khan was incarcerated in Kashimpur prison from 13 August 2013, on 11 September an arrest warrant was issued for ASM Nasiruddin Elan. On 10 October 2013, ASM Nasiruddin Elan was granted an order of ‘no arrest or harassment’ for four weeks from the High Court Division of the Supreme Court. On 11 October 2013, Adilur Rahman Khan was released on Bail after spending more than two months in Kashimpur prison; while the tenure of the court order for Elan has almost come to an end. ASM Nasiruddin Elan and his lawyers appeared before the Cyber Crimes Tribunal this morning, 06 November, and appealed for bail. At 12:20 in the afternoon the Judge, Shamsul Alam, rejected the plea for bail and ordered that Elan be arrested and taken to jail.
